Public and private procurement of security services, the statement of the situation

At the turn of the summer, Milan Public Prosecutor's office ordered the external administration of some of the major security operators for having paid salaries to operators in auxiliary services lower than the poverty threshold calculated by ISTAT, thus contravening the dictate of art 36 of the Constitution.

The commissioners have taken steps to align salaries with the poverty threshold by adopting CCNL of similar categories awaiting the revision of the supervisory one. The immediate increase in labor costs for service providers subject yo judicial administration can be estimated at 20%. This increase will concern the entire sector following the reformulation of CCNL for supervision among the most representative parts still underway at Labour Ministry.

We will not deal with the related criminal and labor law aspects or even with the ethical ones, but with the consequences on the public and private contract market.

The rates of services provided to clients - tipically Public Administrations, big companies, banks, retailer, logistics - will have to be adjusted in proportion to prevent service providers from going into defauls with possible interruptions in the provision of some essential services for continuity operational of the client.

The first point that will be examinated is the verification of the regulatory context of public contracts to understand which are  the legal possibilities  to allow Public Administrations to quickly adjust tariffs in contracts under construction and  identify compatible solutions.

The second point, concerning in particular private contracts, will be the ability of service providers to redevelop the services offered to allow clients to absorb increases in the price/performance ration by optimizing the use of resources.

Conversely the ability of clients to exploit those added value resources will have to be developed by reviewing their organizational models.
